Distribution Policy: Breach and Penalty

At Be Musix LLC, we strive to maintain a fair and transparent distribution system for all our clients. In order to uphold the quality and integrity of our services, we have implemented the following breach policy. This policy outlines the consequences of violating the terms and conditions of the distribution agreement and the actions that will be taken by the Be Musix team.

1. Breach of Terms and Conditions

If a client fails to adhere to the terms and conditions outlined in the Be Musix LLC Distribution Policy or Service Agreement, they will be subject to the following actions:

  • First Breach:
    • The client will receive a written warning from Be Musix LLC notifying them of the violation.
    • The client will be given 24 hours to rectify the issue and bring their account into compliance.
  • Second Breach:
    • If the issue is not resolved within the given time period or another violation occurs, a second written warning will be issued.
    • Be Musix LLC will impose a penalty fee of up to $100 for the breach. The penalty will be deducted from the client’s future earnings or payments.
    • The client will have 48 hours to correct the breach and avoid further penalties or actions.
  • Third Breach:
    • Upon the third breach or failure to resolve the previous violations, Be Musix LLC reserves the right to suspend or terminate the client’s account without notice or reason.
    • Any remaining funds or royalties owed to the client at the time of termination will be forfeited, and the client’s music will be removed from distribution.

2. Penalty for Non-Compliance

  • Up to $100 Penalty: The maximum penalty fee for non-compliance with the terms and conditions may be imposed after the second breach.
  • Account Termination: Following the third breach, Be Musix LLC has the discretion to terminate the client’s account, even without providing specific reasons. Once terminated, the client will lose access to all Be Musix LLC services and their music will no longer be distributed through our platform.

3. Exceptions and Appeals

  • Be Musix LLC understands that mistakes may happen. If the client feels the breach is due to an error or misunderstanding, they have the right to appeal the decision by contacting our support team. The appeal must be submitted within 24 hours of receiving the breach notice. Be Musix LLC will review the appeal and may modify or reverse the penalty or suspension, depending on the situation.

4. Important Notes

  • Be Musix LLC reserves the right to take action on violations that are deemed severe or that jeopardize the integrity and operation of the service, including but not limited to content infringement, fraudulent activities, or abuse of the platform.
  • The policy outlined above applies to all clients who have signed a distribution agreement with Be Musix LLC, and any subsequent modifications to the policy will be communicated directly to clients.

By utilizing the services of Be Musix LLC, clients acknowledge and agree to abide by this breach policy, including the possibility of penalty fees or account termination for non-compliance.


This section ensures that Be Musix LLC can maintain a structured and responsible environment while providing fair notice and the opportunity for clients to correct issues before penalties or termination are enforced.
