Our distribution policy outlines the terms and conditions under which Be Musix LLC offers music distribution services to artists, record labels, and other clients. Please read the following policy carefully to understand the guidelines, rights, and responsibilities for using our services.
1. Eligibility
To use our distribution services, clients must:
- Be at least 18 years of age or have legal guardianship.
- Be authorized to distribute the music content (whether as an artist, producer, record label, or authorized representative).
- Ensure that all content submitted for distribution complies with applicable laws, copyright regulations, and intellectual property rights.
2. Submission of Music
- Clients must submit their music content (audio files, artwork, metadata) via the Be Musix LLC platform in the required formats.
- Accepted audio formats: WAV, MP3, FLAC (check specific platform requirements for each).
- Accepted artwork formats: JPEG, PNG, GIF.
- Metadata must include all relevant information, including but not limited to: artist name, track title, album name, genre, ISRC codes, and any necessary licensing or legal notes.
3. Content Ownership and Rights
- Clients guarantee that they own all rights to the music they submit, including all copyrights, trademarks, and licenses.
- If a third party (e.g., collaborator, producer, etc.) has rights to any part of the content, the client must have written permission or licenses from all relevant parties.
- By submitting content to Be Musix LLC, the client grants Be Musix LLC the worldwide, non-exclusive right to distribute, promote, and license the music across a variety of platforms (e.g., streaming services, digital stores, etc.).
4. Distribution Channels
Be Musix LLC distributes music across a wide range of platforms, including:
- Major streaming services (Spotify, Apple Music, Tidal, etc.).
- Digital download stores (iTunes, Amazon Music, etc.).
- Video platforms (YouTube, Vevo, etc.).
- Other digital and physical distribution channels as applicable.
Be Musix LLC reserves the right to select, remove, or add new distribution platforms at its discretion. Distribution is generally provided worldwide unless otherwise agreed upon.
5. Payment and Royalties
- Be Musix LLC operates on a revenue-sharing model. Clients will receive a percentage of the earnings generated from their music’s distribution, based on the terms outlined in their individual agreement with Be Musix LLC.
- Payments will be processed through the agreed payment methods (e.g., PayPal, bank transfer, etc.) once the revenue threshold has been reached.
- Be Musix LLC will provide clients with regular statements that include detailed information regarding sales, streams, and royalties.
6. Content Quality and Compliance
- All submitted music must meet Be Musix LLC’s quality standards. This includes, but is not limited to, sound quality, file integrity, and adherence to technical requirements for distribution platforms.
- Be Musix LLC reserves the right to reject or remove any content that:
- Violates any laws or rights (including copyright infringement).
- Contains offensive, discriminatory, or otherwise inappropriate content.
- Does not meet the technical requirements for distribution platforms.
- Is found to be misleading or fraudulent in nature.
7. Term and Termination
- Clients may distribute music through Be Musix LLC for as long as the service agreement is in effect.
- Either party may terminate the distribution agreement with [insert notice period, e.g., 30 days] written notice. Upon termination, Be Musix LLC will cease distribution of the music on all platforms but may retain certain data for reporting and royalty purposes.
- Be Musix LLC may terminate or suspend distribution of music at its discretion in cases of violation of this policy or breach of the service agreement.
8. Confidentiality
- Be Musix LLC will protect client information in accordance with its privacy policy. Any personal or business-related information shared will not be disclosed to third parties without the client’s consent, except as required by law or necessary for the execution of the distribution service.
9. Indemnification
- Clients agree to indemnify, defend, and hold Be Musix LLC harmless from any claims, damages, losses, liabilities, costs, and expenses arising out of:
- A breach of any of the client’s representations, warranties, or obligations.
- The music content submitted by the client.
- Any claims related to intellectual property rights or other legal issues concerning the submitted content.
10. Amendments and Modifications
Be Musix LLC reserves the right to amend or modify this distribution policy at any time. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the revised terms.
